Lviv administrative court partly satisfied claims of EPL against General prosecutors' office

On February 09, 2010, Lviv administrative court partly satisfied claims of EPL against General prosecutors' office in which EPL asked the court:
1. To declare as illegal inaction of the defendant in examination of the complaint of EPL that dealt with the violation of the legislation on access to information and public participation in decision making process on environmental matters;
2. To oblige the defendant to examine the complaint;
3. To prohibit sending EPL's complaints to the bodies, actions of which are challenged;
4. To oblige the General prosecutors' office to clarify to the prosecutors of lower level the necessity to deal with the complaints and not to send them to the bodies, actions of which are challenged.

The court satisfied first two claims. Claims No 3, 4 were not satisfied as the court stated that they cannot interfere into the work of General prosecutors’ office and cannot make the decisions concerning the future violations which may not even happen in the future.
EPL thinks that there were not enough grounds for refusal to satisfy these claims. By satisfying them the court could have prevented the violations of the legislation in the future.
