Aarhus Convention Compliance Committee will consider Ukraine’s compliance again

On December 18th of 2009 the Aarhus Convention Compliance Committee on its 26th meeting will consider the Report of Ukraine on the progress of implementation of the decision of MOP3 and bringing legislation and practice into compliance with the Convention. In 2008 on the MOP3 Ukraine was obliged to develop a Strategy to transpose the Convention into domestic legislation in order to resolve the problems identified by the Committee earlier in the case against Ukraine. Having reviewed the Strategy at the begging of 2009, the Committee expressed its concern regarding very general nature of the Strategy. It reserved its right to recommend to the MOP to issue a new caution if after considering the Report on implementation of the Strategy, it concludes that Ukraine has not introduced a clear mechanism of public participation.

As a claimant in the case against Ukraine, EPL was invited to participate in the meeting and present its position on the progress of Strategy implementation. Earlier EPL submitted its arguments on inadequacy of actions taken by the Government. Meanwhile, EPL hopes for cooperation with the Government in development of new legislation creating a clear national mechanism for public participation in environmental decision-making. In Geneva EPL will present its recommendations for successful implementation of the Convention in the domestic system.
