On February 29, 2016 Chief Sate Enforcement Officer of the Unit of Enforcement of Judgements of the State Enforcement Service Department of the Ministry of Justice of Ukraine adopted a regulation on imposing fine on the State Service of Geology and Mineral Resources of Ukraine in the amount of 680,00 UAH for non-enforcement of the court judgement and legitimate demands of the State Enforcement Officer without valid grounds .
Background information: On December 30, 2015 on the basis of the application of the International Charitable Organization «Еnvironment-People-Law» enforcement proceedings were opened with respect to enforcement of Executive Order № 813/7397/13-а dated from October 12, 2015, issued by Lviv Circuit Administrative Court, according to which the State Service of Geology and Mineral Resources of Ukraine is obliged to give the International Charitable Organization «Еnvironment-People-Law» (EPL) a copy of the special permission to the use of mineral resources to ensure implementation of the agreement «On Distribution of Carbohydrates Extracted in Yuzivska Area between the State of Ukraine and the Company «Shell Exploration and Production Ukraine Investment (VI) B.V.» and LLC «Nadra Yuzivska», and 7-day term is provided for the independent enforcement of the court judgement, and this 7-day period starts with the moment the regulation on proceedings was issued.
Together with the regulation on imposing fine the State Service of Geology and Mineral Resources of Ukraine is sent a demand of the state enforcement officer on immediate actions regarding enforcement of the aforementioned Executive Letter. In case the legitimate demands of the state enforcement officer are repeatedly ignored, the person from the State Service of Geology and Mineral Resources of Ukraine who is responsible for the enforcement of this judgement, is faced with criminal responsibility.
As of March 17, 2016 the court judgement is not enforced. EPL has not obtained from the State Service of Geology and Mineral Resources of Ukraine a copy of the special permission to the use of mineral resources to ensure implementation of the agreement «On Distribution of Carbohydrates Extracted in Yuzivska Area between the State of Ukraine and the Company «Shell Exploration and Production Ukraine Investment (VI) B.V.» and LLC «Nadra Yuzivska».
