On 6 November 2017, Lviv Appellate Administrative Court supported the decision of Ivano-Frankivsk Circuit Administrative Court of 23 June 2017 (http://www.reyestr.court.gov.ua/Review/67480505) to declare unlawful the transfer of 5,5 ha of agricultural lands for lease by another pig raising complex of «Danosha” Ltd.
The plaintiff, a resident of the Tlumach district of Ivano-Frankivsk oblast, being aware of the risks of the planned activities, does not want to live next to such an enterprise. He knows what potential consequences can have the lease of land by the State Land Cadaster Office in Ivano-Frankivsk oblast if there is no dialogue with local population.
Failure to comply with the procedure of normative monetary valuation of land, allocation of the land that was used for years as a pasture for the construction of a pig farm without changing its intended purpose, lack of necessary approvals from local executive authorities became the basis for challenging the decision of the State Land Cadaster Office in Ivano-Frankivsk oblast on allocation of the land for lease.
After examining all the evidence in the case, collected by local residents with the help of lawyers of International charitable organization “Environment-People-Law”, the courts of the first and appellate instances adopted a legitimate and well-grounded decision, thereby supporting residents of the Tlumach district of Ivano-Frankivsk oblast in their desire to preserve clean and safe for health and life environment for them and their families.
