On July, 10, 2013 the District Administrative Court of Kiev will consider the claim brought by EPL against the Cabinet of Ministers of Ukraine and NNEGC «Enegroatom» asking the court to demand release of 27,72 ha of protected lands flooded by Oleksandrivsky water reservoir.
Theplaintiffasksthecourttodemandthereleaseof 27,72 haoflandswhichwereallocatedtothenuclearenergycompanywithviolationsofthelawswhichwasconfirmedbycourts, includingtheSupremeCourtofUkraine. Theplaintiffalsoasksthecourttodeclareinvalidthestatelandcertificatesissued to NNEGC «Enegroatom» in 2006.
Forinformation, in 2011 and 2012 theadministrativecourtsandtheSupremeCourtofUkraine declared the invalid the decision of the government of Ukraine allocating 27,72 ha of the protected lands of the Regional Landscape Park “Granitno-stepove Pobyzha”for Oleksandrivsky water reservoir of Tashlytska HAEStaken in 2006. Nevertheless, the state land certificates were not declared invalid,thus “Energoatom” continues to exploit these lands and to keep them flooded by Oleksandrivsky water reservoir. Thecourtdecisiononthereleaseof 27 haoflandswillleadtotheloweringofthelevelofOleksandrivsky water reservoir along the riverbed of South Bug river to 8 m, which means natural level of the river. Oleksandrivsky water reservoir is necessary for the exploitation of the Tashlytska HAES, located near the South-Ukrainian NPP and aimed at mitigation of peak voltage in south-western part of the united energy system of Ukraine. But the performance of its functions by TGAES is possible without increase of the level of Oleksandrivsky water reservoir, which is confirmed by official decisions and conclusions.
