Previously, on EPL’s information resources, we already informed about the initiative to create the Register of damage caused by the Russian Federation against Ukraine (hereinafter – the Register). The creation and adjustment of the work of such a Register is a fundamental element of functioning of the compensation mechanism for Ukraine.
It is important that the civil society monitors creation and functioning of the Register of Damage Caused by the Russian Federation Against Ukraine. This ensures transparency, access to information, control over government actions and setting correct priorities in the restoration of our state. Civil control in this area contributes to the fair resolution of the consequences of the unprovoked war unleashed by Russia on the territory of Ukraine.
In view of the above, EPL submitted to the Ministry of Justice of Ukraine (hereinafter referred to as the Ministry of Justice) an information request with questions regarding practical issues of the Register functioning.
In response to the information request the Ministry of Justice stated the following:
The Committee of Ministers of the Council of Europe created the international Register of Damages Caused by the Aggression of the Russian Federation against Ukraine. This register serves as a documentary form of accounting for claims for compensation for damages, losses or damage caused by Russian aggression. Ukraine has its representative in the conference of participants of the Register, where representatives of the countries that joined the agreement on its creation and operation participate. The first meeting of the conference has already taken place and the practical aspects of the registry functioning were discussed. The International Register of Damages will be located in the Hague, Netherlands. Currently, organizational measures are being implementing for the Register launch. This Register is an important part of the compensation mechanism, which will enable determination of compensation amounts based on submitted applications and evidence.
Comprehensive categorization of claims, damages, evidence and affected entities is at the stage of active development and discussion with international partners. The main goal of this work is to maximize coverage of all categories of damages to ensure fair compensation for all victims. Active work is currently underway to develop and adopt detailed rules and regulations that will determine the procedure for submitting applications, the criteria for their admissibility, and the types of damages that will be subject to compensation.
The concept of creating a compensation mechanism, taking into account the amount of damage caused, foresees the urgent need to restore Ukraine and the well-being of its population through payment of compensation. However, implementation of this plan also depends on decisions made by foreign partner states, on whose territory the funds necessary for compensation payments are blocked.
It is planned that environmental damage caused by the Russian Federation as a result of the armed aggression against Ukraine will be included in the categories of damage that will be compensated through the created compensation mechanism.
In order to quickly and widely distribute detailed information about the start of accepting applications to the Register, this information will be actively distributed among potential applicants, the public, states and relevant international organizations.
