Architects of the Institute of general plan of Kyiv offered to donate part of the national park “Holosiyivskyi” for making additional entrance to the future shopping mall.
On August 31, 2016, there was a session of Architecture and Town Planning Council at the Department of Urban Planning and Architecture of the Kyiv city state administration, which presented the project of “changes of detailed plan for the district Teremky-3 in Holosiyivskyi district of Kyiv”. As rightly stressed members of the Architecture and Town Planning Council, the decision about necessity of such a project was not taken by anyone. Project developers do not hide that the project was initiated by investors of the construction of the shopping mall “Republic” and the residential area around it. At the meeting of the Architecture and Town Planning Council one could repeatedly hear the remarks that “we took into account the wishes of developers …”
The design of the project does not take into account the requirements of environmental legislation. In particular, the road to the mall “Republic” from Odessa highway E-95 the architects planned through the national park “Holosiyivskyi” – the tract “Teremky.” The area plan has no reference to the “Teremky tract” and thus its territory was not taken into account. The area of the tract is part of the zone of regulated recreation of the national nature park “Holosiyivskyi” and belongs to the I. I. Schmalhausen Institute of Zoology of the National Academy of Sciences of Ukraine. Before the establishment of the national natural park “Holosiyivskyi” the Institute of Zoology had been protecting the territory of the tract since 1944, having preserved it as one of the last natural areas in Kyiv with mature oak forest.
The administrations of the Institute of Zoology and the national nature park “Holosiyivskyi” were categorically against construction of the road through the protected tract. However, as the deputy director of the Institute of Zoology N. Derevianko states, in the letter from the Institute of general plan of Kyiv to the Institute of Zoology #11-1475 of 26.08.2016, “the wishes of the institute” were taken into account.
Article 54 of the Law of Ukraine “On Nature Reserve Fund of Ukraine” notes that the withdrawal of territories from area of nature reserve fund is possible only when there is scientific justification of environmental feasibility of such a withdrawal, which must be approved by the Ministry of Environment and Natural Resources of Ukraine. Preparation of this project, and in particular further adoption of the presidential decree on withdrawal of lands of the national nature park for the construction of an additional driving way to the mall is not possible.
EPL environmental scientists informed members of the Architecture and City Construction Council that under such conditions the city construction documentation cannot be approved. For this reason and also in view of a number of drawbacks of the project, the Architecture and City Construction Council did not approve the project.
