Results of communication with the Prosecutor General’s Office
EPL continues communication with representatives of the Office of the Prosecutor General (hereinafter – OPG), including authorized persons of the Specialized Environmental Prosecutor’s Office. In the course of a series of working meetings and communication with a number of representatives of the OPG, there were identified the most controversial and problematic issues in terms of prosecution for criminal offenses against the environment and ecocide.
Currently, EPL’s work is focused on the following issues:
Interpretation of evaluative terms included in the crime of “Ecocide” under the criminal law of Ukraine.
Distinguishing between the composition of the criminal offense “Ecocide” and the composition of the criminal offense “Violation of the laws and customs of war”.
Justification of the position regarding the (im)possibility of a person to commit the crime of ecocide through omissions.
Forms of guilt and types of intent in the paradigm of the composition of the crime “Ecocide” under the criminal law of Ukraine.
It is important to emphasize that in terms of interpreting the composition of crimes, specialized non-governmental organizations, in particular such as EPL, are able to use their experience and expert knowledge, which can be useful in investigating and proving the fact that such criminal offenses have been committed. This, in turn, can provide a more accurate understanding of components of the crime and consequences for the victims.
We hope that EPL’s materials and experience in this area will be useful for the prosecutor’s office and will contribute to the prosecution of persons guilty of criminal offenses against the environment.
