Essence of the case: arrangement of control over the activity that influences climate in Ukraine
Essence of the problem: There is no proper control over the activity that influences climate change, the list of enterprises that commit GHG emissions is not created in Ukraine, the amount of GHG emissions is not calculated, etceteras.
Core facts:
National NGO “Environment-People-Law” sent informational requests to the Cabinet of Ministers , National Agency of Environmental Investment (NAEI), Ecological State inspection of the Ministry of Environmental protection to clarify the question how the control over the activity that influences climate is executed in Ukraine.
According to p.2 art.16 of the Law of Ukraine “On protection of atmospheric air”(“Regulation of activity that influences climate and weather”), according to international agreements, enterprises, foundations and organizations are obliged to reduce with further ceasing, manufacturing and usage of chemical substances, which have harmful impact on atmosphere as well as to reduce emissions of CO2 and other substances, accumulating of which in atmosphere can cause negative changes in climate.
Preconditions and mechanisms for implementation of standards mentioned above must be developed . As for today, responsibility for violation of existing standards is not envisaged by law.
